    Default Can the Landlord Change a Lease

    My question involves landlord-tenant law in the State of: Florida. My landlord and his neighbors having been awful. My landlord originally agreed to 775 a month. Then all of a sudden our next door neighbor started complaining to our land lord with false accusations. Which he of course believed. So he decides a month after we move in he wants 1000 a month and a 1000 dollar deposit. I have never signed a new lease and now today he is trying to change it to month to month. Honestly we have NOT been late period. Our neighbors constantly make up bogus things which he believes. He lives 6 hours away so he can't see for himself. I need to know if I can fight him on this. Not only is he trying to change the lease but he gave keys to our neighbors and allowed them in the home when we were gone. Also I have told him about things needed to be fixed. My daughter is legally disabled and has no air in her room. We have mold and asbestos which I have told him. So he puts the house up for sale and says if there is asbestos than it would be the new owners problem because it wasn't in the disclosure. My family and I have been constantly fighting with him and our neighbors. I am at my wits end I do not know what the laws are. I am originally from Texas so I am not sure what to do. Please someone tell me what are my rights.

    Do you have a current written lease or are you a month to month tenant?

    Told him how? Verbally? In writing? It is always good to make repair request in writing so you have documentation of such.

    " We have mold and asbestos which I have told him."

    In regards to the asbestos....so?? Asbestos alone is not an issue if left undisturbed. Someone is not doing construction on the house currently are they?

    In regards to mold, most mold (especially in warm climates such as Florida) is mildew, especially in warm, moist places such as bathrooms.

    Do you have a written lease or do you not have a written lease?

    If you don't have a written lease then you are on month to month and the LL can change the agreement with proper notice and can also terminate your tenancy with proper notice.

    I suggest you read the Florida landlord tenant statutes for the rights and obligations of both parties.

    Explain that better. You moved in on a lease for an initial term, that has expired? And that lease says that upon expiration the tenancy switches to month-to-month? Why did you choose not to sign a "new lease"? Was one even offered?

    The lease that I have is a year lease. No I verbally told him about the things that needed repair. Yes in my daughters room the ceiling has been bashed in and disturbed by his orders. The ceiling is caving in through out the house so he had the neighbor come in and start building a new structure under the current ceiling. The neighbor broke off the original ceiling where the air duct is present. The mold or mildew is in the bathroom also in some bedrooms.

    My lease is current from December 1, 2012 til December 1, 2013. A one year lease. I did not sign any other lease. Simply because he is trying to get money from my Mom. I am a 33 yr old woman and my husband is 43, we pay our bills every month. Never late on the rent. But our neighbors do not want anyone in this house. They have harassed us constantly since we have lived here. This is what happened to the renters before us too.

    If you have a one year lease that ends in December, fixing rent at $775 per month, then your rent is $775 per month. If your landlord wants to raise your rent he may do so effective December 2, should you choose to remain in residence.

    No changes to this lease can be made unless ALL involved (you as the tenants AND the landlord) agree to these changes.
