My question involves collection proceedings in the State of: North Carolina
My father had a Discover Card with a $6,000 debt that he discontinued the use of in 2006. The account was in his name entirely but I had a card with my name on it tied to that same account. About three years ago the debt was showing up on my credit report. I disputed it saying that it was not my debt as my name was not on the actual account and it was removed. Since then my father began receiving letters from an attorney/collection agency in regards to the debt to which he hasn't replied. He passed away a few weeks ago and my questions are:
A: Knowing the statute of limitations in NC is 3 years, do they have any legal grounds to still come after this debt being that it is so old?
B: Now that my father has passed away, would my Mother or I be responsible for the debt?
C: With the exception of paying them, what should my plan be to resolve this moving forward?
Thanks, I appreciate any and all help I receive!
