My question involves a marriage in the state of: Indiana
I married my wife in August 2009 and she had approximately 90 credit hours towards a bachelor’s degree. We decided I would continue to work, while I supported her complete her bachelor’s degree and apply to Dental school. She has not worked since we have been married and I have fully supported her financially (emotiontally, chores, ect) and used student loans to pay for tuition and other personal expenses. She just started her 4th and final year of dental school (Doctor of Dental Surgery) and decided she wanted a divorce and would not accept counseling. She left me to deal with the house, dogs, ect.
She feels no need to reimburse for increased future earnings or previous student loans payments made from a joint account.
With the new student loan laws and income based repayment, she does not have to pay these loans back, but only face a reduction in future earnings. I am not clear with Indiana divorce law if I am entitled to any future earnings, but I feel the new student loan repayment (income based repayment) should impact the way it is viewed in divorce. She simply has a reduced income for a number of years and the debt is discharged.
Her mother has made a threat against me, if I pursue legal action. I notified the authorities and she has been told not to come back to my residence. I feel that because I am a male, I suppose to accept these consequences (my wife receive 5k and her car and walks away).
Also, I feel an inappropriate relationship with a University of **** professor caused my divorce. They would often send late night facebook messages and he discussed opening a practice with her after she completed a specialty program at the University of Florida (he would make sure she got in). Civil Case?
I am not sure if you could be of assistance, but I wanted to get feedback if I could pursue any legal action for my emotional and financial loss.
