My question involves a marriage in the state of: Michigan
I was divorced in 2003 and my ex husband was responsible for paying a property settlement inlieu of child support and alimony. We had purchased a home and paid the down payment of $32,000 with an advance of my inheritance from my father. The property settlement included that my ex husband be responsible for the house payment along with several other bills. He fell behind in the house payments and signed a paper with the mortgage company that he would make 6 payments on time and they would put the 3 months that he was behind ..at the end of the loan. The divorce judgment also states that if the home were sold, I would get the first $32,0000 from the sale because that was my inheritance.
My ex husband paid 4 months on time and then started shorting me $1000 every month paying the total property settlement...which is documented by Friend of the Court. I covered what the delinquency was on the house payment for the 5th month however was not able to on the 6th month of agreement he entered into...and the home went into foreclosure. I did a chapter 13 bankruptcy for 2 years and my ex husband continued to accrue a severe arrearage in the property settlement payments (well over $20,000..which was being constantly fought over in court) I finally had to convert to a chapter 7 and subsequently lost the home in foreclosure.....and losing my $32,000 of my inheritance.
Can I sue my ex husband for this money?
