My question involves police conduct in the State of: Texas
I was the named victim in a Domestic Violence issue. I didn't think it was but my husband and I got into a fight and he bit me and slapped me. The bite was a response to me biting him and the slap was a result of me saying "Go ahead and hit me". Anyway I called my dad to come get me we just need some space. After telling my dad he connected me with the local police via 3 way and told them his daughter was assaulted and told me the only way to protect me was to report it to the police, so I did. I didn't think about the DV charge. Anyway at the police station I was told to make a statement and did not lying, but tried to tell them that I bit him first they said we would get to that later and we never did. I was there about 6 hours and that whole time they did not even mention to me that I was a victim. Not to mention they kept my phone that whole time.
A few other details. When the picked me up I was on the road not on our property (which is a fenced ranch) They didn't arrest him until 6 hours later. No one has ever asked me for my version. They provided not information on court proceedings and when I inquired they said I wasn't the victim I was the spouse.
I don't deny that it happened but I don't think this is an appropriate charge. I am not a manipulated little girl, I am a 40 year old with my own financial independence. I also filed an affidavit of non prosecution they didn't respond.
any suggestions on how to get this dismissed. If the prosecutor said I wasn't the victim that should do it in my opinion.
