    Exclamation Can an Employee of Owner Enter Apartment Under False Pretenses

    My question involves landlord-tenant law in the State of: Massachusetts

    Hello,
    Recently while I was at home I heard a knock on the door from the maintenance guy who was hired by the owners to do work on my building. He said that "there was a leak below me and he needed to come in to check my living room. Since I considered this an emergency I let him in. He came in with a guy that works with him and they went to the living room and looked around in the living room then left. I was cooking at the time so I didn't really pay attention to them, but for some reason I felt suspicious about the whole thing so later I went downstairs to the lady who lives below me and asked her if I could see the leak. She said had NO leak and looked very confused.

    So my question is what legal options do I have? I believe this man and his "worker" entered my apartment for some reason under false pretenses. They did not assault me in any way or take anything to my knowledge, they just came in for some reason. I've had previous problems with this man because he doesn't have the best demeanor, his work is sloppy, and he enters apartments WITHOUT notice. I actually had an incident where he came without notice to do some work in my apartment and when I refused to let him and asserted my rights; He dangled his keys in my face and said that he could go into any apartment, whenever he felt like it. All of these things have been reported to the owners and they all always apologized and made him apologize to me on one occasion. They also promised that he would no longer be able to enter my apartment but that promise was soon broken. So I don't know what to do. I let him in because in my lease although they have to give me notice for inspections and repairs and such, they do not need it for emergencies. I don't know what to do now or in the future if the owners do not take this seriously and get rid of him then what will I do in the future? If he comes knocking on my door with another emergency how can I just let him in? Even though I was not harmed in any way I'm still a bit scared and worried about the whole thing...

    What kind of legal options are you looking for? What damages do you have?

    Serve him with a notice of trespass and see what happens ...
