    Default Potential Liability for Back Support

    My daughter is 16 yrs. My X never wanted child support by i have helped her when she needs it. Recently she told me that she receiver some child support papers & that i was going to have to pay child support. I have no problem with this but i have some questions. Do i have to pay backpay? If she never filed until now, do i pay backpay for the past 16 yrs? My daughter lives in Colorado with her mom. She does not want child support but she receiver paper work, what can we do if she does not want it?

    You will not have to "backpay"
    Child support is not retroactive.
    You will need to pay starting when the papers are filed.

    Do you know if the mother was ever on any state assistance? She may not be asking for child support, it may be the state trying to get their money back for any monies they may have given her.

    That is what we think that has happened. I send her $400 a month since day 1 but all of a sudden this happens. Maybe it's better this way.

    There are some states that will order retroactive child support, not 16 years worth, but they will order it.
