    Post Immigration After a Shoplifting Case

    I am an international student from India, did my Masters from US and now working as a full time employee in Kansas City, MO. Last year around the month of May I was arrested in shoplifting case in Kansas City, Missouri and was in cell for 1 hour or so until paid of bond amount. I took advice from local attorney and he suggested me to attend shoplifting class. I did that and then after the case was dismissed without prejudice. I have printer document from court mentioning the same. After this incident, last month of 2012, I visited India and at the time of Port of entry, when I did my finger print Immigration office asked me to go in a separate room and there they asked me few questions about my job and also about this case. For case I said it was just a misunderstanding. He said OK and stamped me in. Now, early this year I got my H1b VISA approved and now I am planning to visit India, what you will suggest on this case now? What situation I may face according to your experience during VISA interview and in reentry into US and How I have to handle/answer it?

    Your expert opinion will really be appreciated.

    Just because you apparently steal everything not tied down in India, the US being called the land of opportunity, is not for that type of opportunity. I suggest you stop stealing and doing all the other bad habits you have. A Us employer may not want to hire a thief. Most attempt not to, even if they will work for 60 percent of prevailing wage.

    I didn't lie, but to save from further questioning I said it was misunderstanding as the case was already closed, but they have record of my finger print.

    You CANNOT avoid discussing the matter in the future. It is a matter of fact and lying in any way could result in a permanent bar from entry into the US.

    If you do not want to deal with the issue in the future, find employment in another country. That is the only sure way to avoid answering questions about this incident.
