    Default Entrapment Defense when Officer is on Private Property

    My question involves a traffic ticket from the state of: California.
    I was issued a ticket where the officer was sitting off the highway on a private driveway. Do they need to have permission to use this place (private driveway) for sitting with their radar? Is this a defence?

    (2) I have on numerous time witness CHP officers traveling at least the speed I was traveling in the exact spot. These are not officers responding to a call. Last on was yesterday where the two motorcycle chp tailgated a car, withing 7 ft of the car's bumber, then cut around the car and almost hit the car when making this move. They where later obsevred going to lunch just up the road. The CHP commonly drive this road at the rate I was issued a ticket at.

    No, it is not a defense.

    Also, not a defense. The fact that the CHP or even another driver might ever have been driving on that spot at a speed greater than the posted limit is not a defense to your doing so.

    Has anyone considered calling the local CHP office and advising them of their observations?
