Can Me and My Brother Receive Our Mother's Social Security

sHe passed away 5 months ago (ny), me and my brother has been having problems and he's keeping all the estate information from me. I live in another state and so far i haven't receive anything from anyone, but one of our family members told me that he's alraedy received a check from the employee's retirement system, but my question is:

Can i call directly to the social security to find out, or i would get in trouble since he's the executor of the estate (no will)?

The FICA taxes paid over the years are not like a deposit into a bank account or an investment. They are more like payment of an insurance policy. If your house never burns down, the insurance company does not refund all your premiums. If your mother died before qualifying for Social Security and has no dependents (minor children, elderly spouse, etc.) eligible to receive benefits, then the money is not paid to her estate.

Your issue is with your brother and your mother's will, if she had one.
