    Question Returning Permanent Resident with Expired Green Card

    I am a 64 yr-old US citizen whose adult son (LPR) left US in Jan 2010 to take care of my two ageing parents (in their eighties), one was bedridden at the time he flew to BU, the other one had glaucoma as was legally blind. In the meantime each of them passed away He wants to return to US. This is his country where he lived more than 14 years, graduated high school and college and had good jobs and paid taxes. Unfortunately his green card expired in 2011--he wanted to return to US in the summer of 2010 when his grandparents were feeling better but he could not find his green card...he asked his grandparents if they knew anything about the green card and they said NO Recently he cleaned the apartment and disposed of most of their old stuff and find the green card under some bed sheets in the linen closet He suspects they had hidden it for fear of his return to US So, my question is what are his chances to return as a LPR and get his green card renewed. I feel so guilty as his mother that I could not go to take care of my old parents (I worked for the fed government at the time and I am supposed to avoid flying by doctor advice as I have a circulatory problem) I feel responsible and I want to help him to return home THIS IS HIS HOME-US. In Bucharest, Romania, where he took care and lived with his grandparents he has no one left...except the apartment which is on my name. PLEASE HELP me to help him. THANK YOU!!

    They will likely deem him to have abandoned his residency and he will need to start the process anew.

    He can apply for an SB-1 (returning resident) permit. It may or may not be granted. I suggest you consult an attorney for advice to obtain the best possible outcome.

    Otherwise, you can file for him as the child of a US citizen.

    Thank you for your prompt reply. I wonder how can an attorney in US help our son, who is in BU, with SB 1 visa. I have read that petition for an adult child takes years to be approved. Regards, C

    The AILA is the organization for immigration law specialist. You could search that to find one with an associate in his area or contact one of the immigration family law specialists in the US to assist; the attorney does not need to be in your state.
