    Default Township Zoning Isn't Being Enforced

    Thank you for your help!!! This pertains to Ohio Townships: in Boston Township, located in Summit County, OH, the zoning inspector isn't "willing" to enforce the zoning codes, thus properties are degrading the community and property values are plummeting. Apart from filing a Mandamus action, what if any procedure is there for (A) removing this 'Trustee' appointed official, and (B) forcing the township to enforce the code?... Can I sue the township for financial damages due to loss of property value?

    2nd question please: (A) the Board of Zoning Appeals is not following the zoning code when granting/denying appeals. The instances are blatant, and recorded via a 'court reporter'. As well, (B) the 'good ole boy' attitude that pervades the township gov't has appointed a severely mentally retarded individual to the Board OF Zoning Appeals, and as a result, Roberts Rules of Order and Procedure are NOT followed, and chaos ensues at every meeting trying to control and mitigate this individuals outbursts, which ultimately results in personal preferences ruling out over zoning code definitions and requirements. What course of action is there for changing this?

    Thank you for your time. Here are facts for 2 specific situations:

    - the township zoning inspector advises a property owner, who's property is in a plated subdivision, zone residential, that the property owner can circumvent the zoning code's "accessory building" sqft & height restrictions if the property owner claims 'agricultural use'...though the property is not dedicated to any ag use whatsoever.

    - the zoning code states that 'junk' (definition of 'junk' is clearly defined in the code) can not be stored/collect on a property, and that if the area of collection exceeded 25sqft, the property owner is in violation and must remove said 'junk'. There are numerous properties where this is occurring, in sq footage far greater than 25sqft. When these properties are reported to said zoning inspector, he states that he'll do nothing about it.

    Tell us exactly what the "junk" is.

    Raise the issue at your township trustee meeting about junk and ag building enforcement. Every community has laws. Every community has a local culture regarding their enforcement. We once had a "by the book" zoning inspector that was citing people for decades long status quo items. The inspector did not last long. Our community also tried speed cameras. We ran those out also. Our police only enforce laws selectively against law breakers presenting a hazard or immediate danger. We as a community accept this, whichever side of the coin you are on.

    thank you: scrap car parts, construction debris, tires, old bicycles, windows and window frames, PVC plumbing pipe, flower pots, dead motor cycles, kitchen sinks...you name it.

    That's definitely junk. Maybe you need to try to go over the zoning inspector's head.
