    Default Sexual Images Sent to Minor

    My question involves criminal law for the state of: a woman in her 20's has sent around 10 nude and semi nude photos to a boy, at the time 15. She also asked for sex on numerous occasions. The boy never sent pictures back. What charges could be brought up on her? Felony? Jail time? They live in the state of Georgia.

    Who are you in this situation? Has the child or anyone with knowledge of the event reported this to the police?

    Any number of charges could be charged, and state or even federal prison time is a real possibility. She should cease and desist and needs to speak with a criminal defense attorney.

    I'm wasn't involved with the situation. The girl lived with me and she did it in my house while I was out of the house. We we on the same phone plan also (don't think that has much to do with it).

    The child I'm hoping is going to the police today to fill the report. Since he deleted the pics and conversation is it possible for the court to pull the phone records??

    If the police investigate, they can subpoena or seek search warrants for phone and internet records, and even seize the victim's computer. Deleted files does not mean "gone" ... they are still there.

    I have a bigger problem now. The 15 yr old wont file a statement. I have text conversations between him and me about the situation. Would that be enough to get the ball rolling? What else do I need to start this process myself?

    You can't start it yourself. You have no legal standing in this whatsoever. This is not your problem, it is none of your business. Period.

    The boy cannot file a statement on his own. He must do this with his parents or legal guardians. You cannot accompany them. If he/they don't want to do this, that is their legal prerogative.

    Again, you have no involvement in this. If you go to the police with this, the police will say something along the lines of "butt out buddy" to you. You might also get sued by the boy's parents/legal guardians for interfering and publicizing their private business. And they would probably win.

    You can report it to the police, but absent some statement by the victim or the suspect admitting to the crime - and some evidence of a crime - the police are not likely to pursue the matter and will likely lack sufficient probable cause to get a case rolling that might allow them to seek a subpoena or a search warrant. They likely will not have the time to chase cases involving uncooperative victims and suspects who have sent pictures but have not yet acted to molest a minor. But, you can always report what you know to them then it is in their ballpark and no longer your concern.

    He doesn't need standing to report a crime. While a third party cannot be a victim, he can certainly be a witness and report what he believes to be a crime against a minor. In some states - and in some professions - such a report might even be mandatory.

    The OP is certainly free to report what they know, but the police may lack the inclination or capability to investigate the matter with no victim statement or confession by the suspect. Though, a good investigator can probably confront the minor and convince him to admit to what happened ... whether that will be enough to pursue the matter will depend on details we cannot know.
