    Angry Burn from Car at a Dealership

    My question involves an injury that occurred in the state of: Pa

    On June 19, 2013, my dad and I visited a car dealer for an appointment at 7:15. I was there to test drive the car and then go over numbers. After the 15 to 20 minute test drive, I was opening the trunk to see the size. As I opened the trunk, my right calf brushed the tailpipe which subsequently burned my leg. The tailpipe was extremely hot and the burn was painful. I still have the burise today. When I told the dealer about the burn the sales man orginally ignored it. Also the orginal sales man made no effort to show us the car thats why my dad and I were going over the car ourselves. I then emailed the sales manager the next day and he keep pushing it under the rug saying he isnt liable for the injury. I was just wondering if he is liable or would this be a waste of time to pursue further. Thank you!

    There's nothing unusual about the fact that exhaust pipes are hot after you drive. Was this some sort of specially modified exhaust system?

    While I do think the sales people could approach the situation better, I do not think they are liable for this reason. It's almost the same as leaning on a car that has been sitting in the sun the whole day and burning yourself. That's just something that naturally happens and really not the dealership's fault. I think they should compensate a little for your injury and I'm sorry it happened but I don't think the company is liable for that - in my opinion.

    The car dealer or salesman had nothing to do with this accident. It may sound a bit rough to you but suppose you have a car and a potential buyer of your car was driving your car. The driver did exactly the same after driving the car and burned his leg. Would you hold yourself responsible for it? Would you compensate for it?

    Tail pipes get extremely hot and they burn you if you touch them.

    Under normal driving conditions exhaust gas temperatures can range from 500 degrees F to 1200 degrees F.

    Put your hand in a pot of boiling water (212 degrees F) and you will get scalded. Touch a tailpipe and you will lose some skin.

    I don't see any liability on anybody's part for something that resulted from your own carelessness.

    Consult a personal injury attorney if you like but I don't see you getting anywhere with this.

    Actually, the exhaust gets even higher than that (perhaps even as high as 1500) in the hottest section of the exhaust. By the time it gets to the tail pipe it's cooler, but as the poster learned, still plenty darn hot.

    In fact, this is one of Bill Engvall's original "Here's your sign" anecdotes when someone reaches down and tries to grab the exhaust pipe after a test drive.
