    Default Buyer of a Pony Wants Her Money Back

    I recently sold a horse to someone, I am not a stable, just selling my 7 year old sons pony, we have taken alot of video of both 3 & 7 yr old boys, climbing, riding, playing, with this pony, we give rides to neighbors etc. anyways, they came down, rode the pony, bought the pony and took the pony home, a month later they email wanting their money back, they said the pony is unruly, which this isnt the first pony they have went thru, two days later the pony was in a field of horses, the lady claims she wasnt watching her 6 yr old daughter and she went in the field with all her horses, they started kicking each other and her little girl was frightened but unhurt, they now want to sue me for misrepresentation of a dangerous animal, child endangerment and false advertising, the pony was great for us and our family, we never had a problem out of her, we asked why not email or call after a week why a month, no response, also she knew better than to let her daughter in the field with horses but its our fault because our horse started the fight, what control do I have over an animal, least of all, how they will act with other horses. I feel like this lady is trying to pull a fast one, and just wants the pony and the money. is there anything I can do, thanks also she bought the animal in Indiana, why do I have to go to Michigan to court.

    That may well be the case. If the only actual witness to the events was the six-year-old daughter, her testimony is probably not very strong, particularly in relation to any allegation that the pony you sold "started it" (so to speak).

    Probably because she lives in Michigan, and it was convenient for her to sue in Michigan. You may well have valid objections to Michigan's taking jurisdiction over the case; that's something, though, that you should discuss with a defense lawyer.

    File a motion to dismiss based on venue. The Michigan court does not have jurisdiction over a sale in Indiana. Just do a little online research and file your motion. You should not need an atorney at this point.
