    Default Paying for Health Insurance for Adult Children

    Currently I am negotiating a settlement in a divorce. I currently have two children on a health insurance policy that are in their late teens. They will be graduating soon from high school and Will probably remain on my policy for an indefinite period of time up until 26 years old. (obamacare). A current cost of 6000 a year and growing.
    My questions:

    How should I go about negotiating this with the spouses attorney?

    Has anyone written a health care stipulation for post majority health care?

    Will this become a big issue in the future of settlements?

    Since it is a Federal mandate will a family court consider this in any settlement rulings?

    I'm not an attorney, so I have no legal advice for you, but I'm confused as to why anyone would be legally obligated to provide medical insurance for their child, past age of majority? Does the "up to age 26" health care provision only specify that adult children can be kept on their parents' insurance up to age 26, not that the parent is legally obligated to keep them on it, non custodial parent or not?

    My understanding is that its an option, not a requirement. However, I would certainly keep my child on to age 26 if I had insurance available and they did not.

    That's what I thought, too. Good for you to be willing to do that. If it's truly unaffordable for a parent to keep their adult child on their medical insurance though, I can understand them not doing so.

    I had a full time job with medical insurance at 22. From 19-21 (my insurance through my parents ended at 19) I just went without insurance, and made do. My parents could never have afforded to keep my siblings and I on their insurance through our mid 20's, even had the option been available. I hope that my kids will be self sufficient before age 26, too.

    It depends on how you define "affordable". My definition of affordable would certain change if my child developed a cancer that was treatable but he/she was going to die because they had no health insurance.

    I define "affordable" as in keeping the adult child on the parent's insurance doesn't mean that the parent will be unable to afford the basic necessities of life for himself, such as housing, food, clothing, transportation, and yes, his own medical care.

    Yes, of course if an adult child has no insurance and a serious illness, the parent should help out any way they can. BUT, if the child is healthy and physically and mentally capable of obtaining full time employment with medical insurance, and insurance for the child is cost prohibitive for the parent, then the child should learn how to stand on his or her own two feet. I love my children, but I also want them to become self sufficient adults one day, too.
