Default Who is Responsible When a Minor Gets Alcohol

My question involves criminal law for the state of: Kansas. Ok. So I was drinking at an event away from home and my original ride left for a different party. I saw a couple of friends I knew, who were headed back where I was going so I got a ride with them. They were already drinking before I got there. I threw my cooler in the back of the truck and rode back. We got stopped, driver got a DUI, Passenger got MIC and I got contributing to a minor. All were over 18 but not 21. I am of age. I told them that I was just riding back with them because of my other ride left early but the police thought it was my beer they were drinking so I got a citation for contributing to a minor. I really don't feel like I should be charged with this but maybe it's one of those "guilty by association" things. I just wanted a ride home. Now I'm wondering what to do about this. Can I fight this? Should I get my own lawyer or take a court appointed lawyer? I'm just really worried right now. I don't have a lot of money and most of my paycheck goes to bills, rent and car payments. Please Help!!!

If you think a jury will buy that story, you have the right to demand a jury trial. I suggest you discuss strategy with your criminal defense lawyer.

Is your "original ride" willing to testify to this? Are the kids in the car willing to testify that they got the alcohol elsewhere and not from you? AND, are they willing to say WHERE they got it?

Do you have any witnesses to support this mystery ride argument?

Your attorney may be able to cast doubt on the state's contentions and maybe can make hay out of the state's inability to provide direct testimony that you contributed to their delinquency, but that's a discussion to have with your attorney.

Oh, and if you can afford your own attorney, the court is not likely to permit you to obtain court appointed legal counsel.

Didn't think I would get in this early but just went and talked to my attorney, today. Very affordable with a good reputation around here. Things are looking good but only time will tell. Thank you for your help. It is greatly appreciated! Keep in touch.
