    Question Falsely Accused of Breaking Into a Home

    My question involves criminal law for the state of: ct
    A state police officer went to my friends and families homes asking questions about me and my whereabouts ,(yet he never came to my address) I finally spoke with him on the phone and he requested I come to the station to talk to him, ...I agreed but ended up not being able to make it ( 45 min ride)I called him back spoke with him found out I have been accused of breaking into a house ( 30 min. from me) and a reported theft .supposedly the owner saw me (she doesn't even know me ,her son does). I answered all his questions gave him a witness phone number as to my whereabouts the day of the crime, he called and verified this with my witness. I thought it were all set. now I get a phone call saying I need to go give DNA to prove I wasn't there. I have not been charged, I know this is her sons doings Now I get a call from Police telling me that because I wont go give dna they will be getting a warrant for my arrest. This police officer is accusing me of being a drug addict and telling me he KNOWS I did it and they will get me down there one way or another. This is such BS , I hardly have the money for life never mind an attorney... what is my best recourse here?? and if I I am arrested can I go after them once im cleared for falsely arresting and accusing me ??

    He does not seem Hell bent to me. He has attempted to fairly investigate. You have attempted to exercise your rights to self incrimination by not co-operating. He feels he has enough evidence to compel an arrest and is doing so. This is the way legal process works.

    You can either give the DNA sample, or you can decline and see if you end up facing criminal charges. The officer may be bluffing, but he may well be prepared to take his case against you to a prosecutor. The choice is yours to make.

    I am not against complying with laws , but being implicated with absolutely NO basis , suppling verifiable witnesses and being told I have to submit dna because someone who doesnt even know me identified me by name seems a bit of a stretch. I though we were innocent until proven guilty??
    this officer is telling me im guilty and I need to prove my innocence ?? I have by supplying him with alibi's and witness numbers which he verified. I have rights too

    The officer is only interested in resolving his case one way or the other. When he says it will be "easier if you comply" it means it will be easier for him. It's up to you, but whenever you are facing criminal actions, it's generally advisable to politely decline to say or do anything until you have advice of counsel.

    am I entitled to know any of these allegations ?? or do I have to wait until I am arrested ? and how can a person get arrested with no evidence ?? merely on heresay and a police officers personal drive ?? I KNOW I had zero to do with this incident and would like to know more about what im being accused of. also Do I have rights to recourse ?? this is obviously going to affect my life more than it has and once it is over I want the wrongful parties punished, including this officer who has outright told me he KNOWS I did it

    If you're charged with a crime, you'll have the right to know the details of the charge against you. As a guy on the street, even if you're a suspect, the police are not under any obligation to share with you the details of their criminal investigation.

    Part of the spiel an officer uses is designed to elicit a confession by you, before you are arrested and read Miranda. They are permitted to lie, to get you to confess.
