I have obtained a bachelors degree in the US under a F1 visa and graduated in 2010. I got a job post graduation so I applied for a change of status from F1 to J1 within the US. Up till today, I have worked 3 years as a J1 scholar at a research lab of a state university. I recently decided to quit my job and go back to school, since I'm subjected to the 2 years home residency requirement, the only way to get anther F1 visa is to go back to my home country to get a visa stamp.
My question is, would my application for another F1 get denied due to immigration intent? (Law 214b) I know that they expect students to go back to their home country after graduation, I did not go home after my first undergrad degree, and now I'm applying for another F1 after working for 3 years. I'm really worried that it would get denied?
Or could I argue that since I'm switching from J1 so I'm subjected to the home residency requirement, I will have to go home thus no immigration intent? Does this reason work? Or they won't buy it?
