    Unhappy Theft of $10 Item at Kmart in 2002, Now..

    Hi, i am from Massachusetts.

    i was young in November 2002, stole car headlights from k-mart.

    i paid (from what they said $100 of $138 dollars) in 2003


    its about 3 years later. the law firm is demanding for $400 in 10 days or they will sue me for it.

    the price increase is "legal fee's or attorney fees"

    i am the only working member in my 2 person family. what do i do? they claim to have been sending me letters for years.. which is not true. because today is the only day i have received a letter. and i have also have changed addresses and setup mail forwarding with eh united states postal service. please help :!!!

    November, 2002, is almost four years ago. You would have to double-check, but a claim that is more than three years old may be past the statute of limitations. You seem to be describing a civil demand, as authorized by this statute.

    yes, i cannot find anything about the time of limitation. it says.

    Pursuant to Massachusetts Ann. Laws ch. 231, 85R 1/2 and/or 85G, K MART may now proceed with litigation against you.

    i lived at the same address where my first check was sent to and where the first request for a check was received. SO. i moved in 2005... but always had mail forwarding set-up. Dunno! what should i do? does anyone have any info about the statue of limitation? ie, is it expired? theres no way they were "attempting to contact me constantly" because i never moved etc..
