    Default Letter from Debt Collector After I Moved

    Hi all,

    About four months ago I received a letter from a debt collector saying I owed around $575 due to an old Comcast account. They stated it was my 2nd notice, but I had never received the first so I was a little panicked that they would take action and report it to the credit bureaus. I drafted up a letter saying I was disputing the debt as was my legal right -- since I had never received the first and they had just dropped it in the regular mail rather than requiring a signature. I went to Comcast's office and they printed up a statement of my old account, which showed a $0 balance, and I included a photocopy of that printout with my letter. I sent it all certified w/ return receipt. They sent me back a similar printout of the account, which had the same name but a different address and different last four #s in the SSN.

    Additionally, I had emailed Comcast because their telephone support was unable to help me and they had a CS rep call me. He said he would send a letter to the company stating I had a zero balance and to leave me alone. I was forwarded a copy of that letter. Because of this, I never followed up saying that the debt belonged to another person.

    Now, I've moved recently and I received another letter from that same debt collection company at my new address! I know under the FDCPA, the collection agency can be fined if they break certain rules. Given that I've disputed the debt AND they've received a letter from Comcast itself, do I have a case against them?

    You indicated that you disputed the debt. That's not the same thing as instructing them not to contact you about the debt.

    Gotcha. Does that mean if I disputed the debt and it is for someone else entirely, they can keep attempting to collect from me until I tell them to go pound sand?
