My question involves a traffic accident in the State of: Washington
I parked my car on a three way street: two lanes for my direction of travel, and one going the other way. I parked my car and was waiting to let the car behind me pass before I got out. As I was getting out, a car hit my door. She was in one lane over, stopped behind a man making a left turn at the intersection. She decided to go around him and in doing so, she hit my car door. As I understand it, the law states that I can open my door when it is safe to do so when the adjacent lane is clear. Since she was in the lane one over, and decided to change lanes, that should means she did not have right of way. Insurance says I had to be observing both lanes of travel, but when I last looked, she was stopped, waiting behind the car in front of her. I find it unreasonable that I should be expected to anticipate an action such as hers. Any advice? I've already filed an Appeal with the insurance company and showed them the RCW's that back up my point.
