    Angry Towing Company Sold My Vehicle After Sending Certified Notice to a Former Address

    My question involves a traffic citation from the state of: IL

    My brother was using my car which has been paid off for over 7 years.The vehicle was parked in his apartment complex lot which does not have assigned spaces, Building Management had it towed as a non functioning vehicle. The towing company sent a registered mail to notify the registered owners which are my in-laws of the towing and but they sent it to the address on the original title which is an old address, after 30 days they sold the car in an auction, the only reason I found out was because the used car dealer who bought the car found some paperwork with my brothers cell number, so he contacted him to ask him if he wanted to pick up his personal belongings. The cars registration had been kept update for over 12 years, and till this date was current with our current address.

    I have spoken to the Towing company and very rudely they stated that there is nothing they can do and that they can only go by what information on the title which is provided by the state. My argument is that why are they going off of title information and not a current 2012-2013 registration information. The registered owners on the title and the registered owners on the registration are the same people but with two different address, the title has an old address of when the car was purchased and the current registration has the current address.

    What can I do ? to get either my car back or the amount it was sold for.

    Aside from where they got the address and whether they checked current DMV records or simply went by the address on the title (you keep the original title in your vehicle?), the vehicle was gone for over 30 days and no one wondered where it went?

    Well, again, it is not your car and the amount it was sold for goes to cover towing and storage fees. If there is any residual after covering those fees then your in-laws get that from the seller. If the amount it was sold for came up short on covering towing and storage fees, then your in-laws could get sued if the towing company wanted to recover those additional fees.
