    Default Changing Child's Name and Adoption

    My question involves name change laws in the State of: Tennessee

    I'd like to have my son's last name changed to my husband's before he begins school in a year from now. Also, down the line we'd like for my husband to legally adopt my son. The biological father has had little to no contact w/ my son since he's been born, I don't receive any financial assistance from him, and he has not signed my son's birth certificate. I signed my son's birth certificate and gave my son my last name (maiden name). We'd really like to have the name changed so that we can have our family unit and so that I never have to hear the questions from my son of why is his last different from the rest of the family.

    I will also add that my husband is a non US citizen but has his naturalization certificate.

    The courts aren't going to change his last name just to give the IMPRESSION that your husband is the father (that's called a "backdoor" adoption, and it's a form of fraud that courts won't participate in). If you want him to BE the legal father, he'll need to complete the adoption.

    We'd really like to have the name changed so that we can have our family unit and so that I never have to hear the questions from my son of why is his last different from the rest of the family.
    The answer being really simple: you have a different father - something that should be disclosed to him anyway at some point, in an age-appropriate manner.

    Someone with a naturalization certificate most definitely IS a US citizen.

    How can he have a certificate of naturalization if he hasn't naturalized as a U.S. Citizen?
