    Default Petition for Removal of a Fire Department Board of Directors

    I am a volunteer fire fighter and first responder for a department out of North Carolina. Our board of directors and chief are not representing the community in a way that is best for the community and hasn't for many years, for starters they are sitting on appx. 350,000 dollars worth of tax payers money and possibly more that should be used to help better the department so that we can better support our community. ISO inspector stated that we needed a strict rescue apparatus and a sub station and much more. The tax payers are suffering because of our board of directors and are having to pay more in taxes than they should. What I was thinking about doing was getting a petition together to have the board and our chief removed from there positions and have the community vote for a new board of directors. They are trying to run the department like they want and are not taking into the fact that they are hurting our community. They question us and protest us anytime we ask for a new piece of equipment that they know will help others but just cant get past spending the money that is given to us for that reason. There is so much more and way too much for me to sit here and type. My question is, is this petition legal and how many signatures do we need for the desired action to take place. Also with this is a community department but we also represent the county we are in, are we allowed to get signatures from departments and boards outside the community or must it only consist of residents of the community?

    Nothing for your question, however, here is an excellent summary of your departments situation and a suggested action plan in the second link. From what I get they report to County Commissioners and are funded similarly. The third link is a manual regarding FD structure and outlines the board is elected according to General Statute 55A. The FD's Articles of Incorporation should outline voting and election procedures for the board.

    You will start by reading the bylaws for your fire department. (For example.) If these directors are elected each year despite your misgivings, it would appear that other members don't share your misgivings. I expect that the volunteer fire department is incorporated as a nonprofit corporation; if so, procedures for removal of directors are outlined here, starting at Sec. 55A‑8‑08. The fire department doesn't fund itself - you may want to try to get your elected officials to exercise some oversight.
