My question involves criminal law for the state of:
My friend is currently on probation, he called me tonite and asked me to show up in court with him next Wednesday, he was served with a protective order, seems that the guy who ratted him out and got him sent to jail put out the protective order. My friend told me that he posted on his facebook page and what he said could be thought of as a threat. I told my buddy that the only thing that could get him sent back to jail was if he either did not see his probation agent, he had a dirty UA, or he got arrested. I talked with a coworker and she thought this could be a violation of probation, she said that if the judge thought he was a threat to society that he could be sent back to jail. My buddy had a 18 months sentence and 9 months was suspended, so he has 9 months of backup time, he asked me if he should tell his probation agent, I told him no, lets see how this plays out. If there is a probation violation and his original judge finds out, is it up to the judge to issue a violation or is it up to the probation agent. Obviously what my buddy did was not smart, when he shows up for this hearing will the states attorney know that he is on probation and could the staes attorney ask for jail time, and will the states attorney or the judge sent something to his original judge saying what took place.
