My question involves a condominium located in the State of: Alaska
In our HOA, the association covers the cost of roof repair/maintenance while owners are responsible for the siding. About 11 years ago all of the roofs were replaced but the flashing was incorrectly installed. The result is that my home has significant siding damage as the water from rain/ice melt flows underneath the siding versus on the exterior of it. The HOA's approach to all of these issues (and nearly every home in the neighborhood has them now) is that they will only cover the cost of the correct installation of the flashing but home owners are responsible for repairing all of the siding damage and rot underneath the siding. I am questioning this because the siding would not have been damaged if the roof flashing had been installed correctly to begin with. The roofing company used years ago is no longer in business so we can't go after them. And, in my case, this all happened before I even purchased my unit so - in my mind - I'm being penalized for a shoddy job that should have been fixed before I even moved into the neighborhood. From other posts on this forum regarding similar issues it appears in other states this has fallen back on the HOA regardless of what the bylaws state. I'd be interested in hearing from folks that may have expertise in Alaska or who could share stories relating specifically to siding from other states.
