    Default Motion to Revoke for Failure to Pay Restitution and Court Cost

    My question involves criminal law for the state of: Missouri
    Hello,
    My mother is 68 years old and is on 3 years SIS probation for a bad check since April 2012. She has been on monthly call-ins for the majority of her supervision because she doesn't have any substance abuse history and aside from traffic tickets doesn't have a criminal record. She was ordered to pay $80 in restitution and $369 dollars in court costs. Recently we received the Motion to Revoke paperwork via the mail and the Prosecution's basis for requesting revocation was failure to pay restitution and court cost. I thought that if the court cost and restitution was paid that maybe they would allow her to continue with her probation. My mother doesn't belong in prison. I've paid everything in full. In your valued opinions what do you believe will be the Judge's likely course of action? Any feedback would be appreciated.

    It appears there was a level of repayment expected that had not occurred. As full payment is tendered, the court will likely continue the probation.

    I doubt they really want to incarcerate her for the crime involved. If all the financial obligations are now paid and she has otherwise complied with all obligations imposed, I cannot imagine them actually locking her up.
