My question involves criminal law for the state of: Illinois
Ok, long story short - I have been stopped at a road block and the officer smelled marijuana in my car. he cuffed me and took to the station where I received two misdemeanor complaints. both of them state that the offense committed is "possession of drug paraphernalia," both of which have the same case #.
here is what i do not understand: i did have 3.5g of marijuana in my car and it was confiscated. i've received a recognizance on which i'm charged with possession of cannabis <10g and possession of paraphernalia. it also states my court complaint case #; however, it does not say that i have been charged with cannabis possession on any of the complaints that i have been given.
what does that mean? does it mean that i shouldn't be worrying about the cannabis charges? or does it not matter.
i am still going to talk to my lawyer but i would like some insight on the situation.
i also need to say that the officer was really cool and it did look like he was trying to help me out ( i was cooperative and what not, he asked if i smoked today..at first i said yes, but then he repeated the question and told me to say no, so i could drive home and don't have anyone pick me up...and possibly avoid getting more tickets).
