    Default Retail fraud and violating probation

    I am on probation for a "speed contest" that was back in June. I was not arrested by the police. The cop just wrote me a ticket and I had to show up in court. I got pre-trial diversion for the speed contest. My terms were take a defensive driving class and probation for 1 year (no probation officer just stay out of trouble) Well in september I was caught in another state for retail fraud in the 2nd degree. I pled guilty and have a pre-sentencing investigation. Should I tell them about my probation in another state. I filled out a form and told them I had never been arrested. Will a search be performed for arrests and convictions? Will my probation show up. Even if it is another state? How do they do the background checks on me? Do they go through just a regular online search?? Because I found for my state they only have a limited background check service. In which you can only find out if one commited a felony or class A misdemeanor and my speed contest was a class B. I guess my main question is. I am moving far away from here in April. Due to my job. Should I let the one state know about my probation? Or should it not affect anything because it was a traffic offense? In the interview I have with PSI how should I act? Respond etc?? This is really eating me up inside and I just dont know what to do.

    You're asking a lot of questions that can't be answered. If you don't abide by the terms of your probation, you risk being caught - but nobody here can tell you the odds that you will be caught. You see an upside to failing to inform your probation officer about what happened, in that you may be able to avoid a probation violation. You need to weigh that against the consequence of possibly being caught not only for the new charge but in a lie (by commission or omission). Consult a criminal defense lawyer in the state and county where you're on probation.
