Can I Get Emancipated?

im a currently 16 years old this december i will be turning 17. my parents and i do not get along at all. my dad tells me i look like a dyke and both my parents tell me they cant stand me anymore. we are always fighting and i am always getting yelled at. my dad is always telling me about everything that i have done wrong and always asks me why i cant do anything right. my parents have very little money to support me anyways because they are both self employed. i really believe that i can make it i have a job and i have a place i will be able to live. i plan to continue high school and hopefully get a scholarship to college. i cant take all the mental abuse and verbal abuse and stuff. its making me depressed and i need to get out of this house. is there any possible way that i would be able to get emancipated? please help.

also, my parents have already been to counseling for this problem along time ago and it hasnt become any better. people say this is a normal thing for a 16 or 17 year old to go through but i dont believe it is. this enviroment is not good for me. i am stressed out and really depressed. i am always crying and i dont know what to do anymore...

To emancipate once you are 17, you will have to show the court that you are "self-supporting and managing [your] own financial affairs". (Texas Statues § 31.001). Will you be able to do that?

what will i have to give to the judge showing that i am self-supporting? and i have a place to live im not sure if they will charge me rent or not will that matter?

Someone "allowing" you to live in their home is NOT self supporting! Self supporting means just that! You must pay all your own bills!

ok so self supporting i got it but if they charge me rent it would be just like im living on my own....

Self-supporting may be defined as "maintaining one’s self without financial assistance from others", or "financially independent". If Texas practice has resulted in a refinement of that term for purposes of the emancipation statute, that's something you would need to check with a local lawyer.

but im paying rent and i have a job and nobody is supporting me... im still paying for my own stuff, my own food, my own place to live, no matter if im living with somebody else i would still pay bills.

i basically just need to know where i would go about getting emancipation papers? and also if i am a good canidate for becoming emancipated?

You can ask your county court if they have standard forms available for emancipation petitions. If not, you may wish to try to obtain a copy of a past emancipation case file to see how to draft a petition.

If you're not self-supporting, you will not be a good candidate for emancipation under the Texas statute.
