    Default How to Select the Proper EB-2 Filing Code/Occupation

    Little background on my Education and work experience in the order of accomplishment
    Diploma in Mechanical engineering (3 years) India
    Bachelor of Arts (3 years) India
    • 1 yr as a customer executive in Campaign Management Unit (telnet, Avaya, SCR software tools) in India
    • Then 4yrs as Assistant Managers for Software Testing in India
    Master in Business Administration with concentration in Information systems (core courses related to database) from USA.
    • Working from past 2 years as Database analyst/Data Conversion specialist (USA) salary 55K
    • Few days ago promoted as Senior Database analyst/Data Conversion specialist (USA) 63K.

    My company a Michigan based American company filed for my H1B as a Database administrator last year and now is willing to file for my EB2 visa.
    With the USA masters and also current job (senior database) did require masters so I think I am eligible for EB2. But when I looked up the www.onetonline.org there is only Database administrator which says bachelors is need nothing that talks about Masters.
    1. Do I need to apply in a different code?
    2. What would be the salary range for that code (to file as EB2)?
    3. Or Am I ok by just using DBA code and mentioning that I’m Sr.DBA with that salary?

    You do not do anything with the filing decisions. Your employer should have an attorney to advise him of the procedures and proper coding that should be used. The job into which you are hired determines the eligibility for EB-2.

    You need to understand your place in the green card process which is basically to respond to requests for information about yourself posed by your employer and his attorney. You should not be making any suggestions or decisions on the questions you posed.

    You have only a three year BS technical degree outside your work area and have a very low salary. You should realize that experience with the filing employer can be used to meet the requirements in very limited circumstances.

    I hope your employer has an experienced immigration attorney working on this petition.
