    Default Fired After Suicide Attempt Despite Clearance to Return to Work

    My question involves labor and employment law for the state of: Utah, I feel as though I need to give a full explanation of why I am here. Sorry if it is to much information but I need to get this figured out.

    So on April 23rd I took a massive amount of pills in an attempt to end my life and I ended up in the hospital in a coma for 5 days. While I was in the coma my brother went to my work and told them that I had a bad accident and I was in a coma but since I did a no call no show for the first 2 days because I was in a coma my boss had fired me even after my brother told him I was in a coma. Well the human resources lady stepped up and said I still had a job and I was put on 30 days unpaid medical leave. Well after 1 week in the medical hospital and 2 weeks in a mental hospital I started taking my medications again and I get out of the hospital only to find out that it is company policy in a situation like my to require the employee to have a psychiatric evaluation done to determine whether or not I am sane enough to do my job since at the time the company I worked for is a sporting goods store and would have access to firearms and ammunition.

    I had 13 days to get it done. I figured no problem I will just call the people that helped me in the mental hospital. Well after 4 or 5 calls and transfers to different departments I gave up and I asked my new Psychiatrist and on my first visit if he could help me out and he determined that I was safe to go back to work with no restrictions and wrote a letter saying as much. I turned it in and I was told that the letter wasn't good enough I need a psychiatric evaluation. Well I signed a full release form for the corporate human resources lady to have the questions answered. Well they backed him into a corner asking him over and over again if I was safe working around firearms and ammunition and my psychiatrist finally relented and told them he did not know me well enough to make that call at this time. So I called the corporate human resources lady on the 24th and was told that since the only option was to have someone with me at all times and they where to busy to do that they had to let me go. I figured fine ok I understand. But now I am $40,000+ in debt with medical bills and I am getting financial aid help from the hospitals but since I was let go from my job I need a letter of termination. So I called and asked them to mail me one and they told me I need to formally request one and list what information I need in the request and I would get the letter by end of day. So I did that and i waited 2 or 3 days and I called to check the status and now the head of HR won't answer my calls I end up having to talk to some other lady and she told me to resend the email with the previous email address I had used and this new lady's address. I did that and was told the head of HR was extremely busy and she would get it to me when she had the time. But now when I call no one answers the phone or I get this second lady who tells me she is in a meeting and will get it done when she has time. My patience is running short and I absolutely need it for my financial aid packets. What should my next move be who do I call? Should I just give up? Is it because they are afraid I will sue them? They already have one wrongful termination suit against them.

    This is not a wrongful termination.

    I'm not even convinced that they have a legal obligation to provide a letter of termination. But standby for others.

    Was your termination legal? Unfortunately, yes. It's pretty crappy that your employer terminated you while you were comatose, but absent a contract or CBA, you can be terminated because you're wearing ugly shoes. As far as a letter of termination goes, I'm not finding anything requiring your former employer to provide one.

    Have you filed for UI?

    No... I was only a employed for 3 months. And to clarify they did not terminate me while I was in a coma they terminated me after I had failed to meet the requirements of my continued employment. Even though my psychiatrist provided a letter stating I was clear to return without restrictions.

    Again your termination is legal, since it is not based on a "protected reason".
