    Default Entering the U.S. While Wanted on a Bench Warrant

    My question involves criminal law for the state of: New York

    I violated the terms of my probation by getting another DUI charge. Both are Felonies in New York, but, they are non injurious traffic felonies. I am in Mexico but need to return I was thinking I could take a cruise ship into Miami, hoping the security would not be as tight as an airport would be when I get to port. Does anyone know if they scan your passport when you go through immigration after arriving via a cruise? If they do, would my active warrant in New York show? I know it will if it is a nationwide warrant, but I am thinking that it is just a local warrant.

    Yes they run your passport through a computer. Yes, you might be arrested.

    So you believe a felony warrant is going to be limited to only the state it was issued in?


    What is your reasoning to guess that somehow you and your passport would be under less scrutiny when coming into the US viu a cruise ship?

    I think you should just play it safe and stay in Mexico.

    Well, I don't know. I am just speculating that because it is a traffic related felony and a non injury or accident related DUI, that it would stay local or maybe go statewide, but not nationwide. As far as cruises, I have never been on one and have no idea what the procedure is for coming back in to the states. I was hoping there would less scrutiny than there is at the airport, but again just speculating. So you know for sure that when you come into port via a cruise, they scan your passport and not just look at it?

    Actually, it was in the last Homeland Security bill that anyone should be able to sneak back into the US via cruise ship. To enforce it, they removed all personnel from the docks. Try hiding underneath the ship.

    Yes, passports are scanned just like they are at airports. You still have to go through customs.

    Default Entering the U.S. After Violating Probation With a Bench Warrant Issued

    My question involves criminal law for the state of: New York

    Can I safely return to US, as long as I don't return to NY? My warrant is for violation of probation and I think it is only a local one, and not a nationwide one. I don't think a lopcal warrant shows up when the scan your passport, but am not sure. Can anyone clarify this for me?

    It is likely it will be in NCIC, as for wheather or not NY will bother to have you brought in, no way to know.
