    Default Falsely Accused of Discrimination

    My question involves labor and employment law for the state of: Illinois

    Can I be written up for asking someone a question about the type of food they like that they took to mean I was asking because the type of food was ethnic. They complained to HR and now I am being written up for it. There were witnesses to this conversation, however, I was told this issue was confidential and I could not talk about it or there would be more disciplinary action. Is this something I can fight?

    It's not illegal, if that's what you're asking. You can be written up for anything your employer finds inappropriate, with limited exceptions.

    You can very, very politely ask if you may explain your side of things and whether or not they would consider removing the write up. There is no law you can invoke that will force them to do so.

    Do you have a union contract with discipline procedures? if not You could be written up for liking a different kind of pizza than your boss.

    If fired for something like that you would likely be eligible for unemployment benefits.
