    Question Allowing a Passenger to Drink in the Car

    My question involves criminal law for the state of: Texas

    I was recently hired as a personal driver to a very wealthy family here in Houston. I drive them around in their Bently and today the lady was drinking wine in the back seat. I know that Texas has an exception for Taxis, Limos and buses but was wondering is any lawyers or police officers here would know if I as their driver could get in trouble for them drinking?

    well, that Bentley is not a limo, taxi, or bus. So you and the passengers would face the charge for open container in vehicle.

    The exact wording is "(1) the passenger area of a motor vehicle designed, maintained, or used primarily for the transportation of persons for compensation, including a bus, taxicab, or limousine; ."

    If you were in a hired Bentley, you might could potentially do so and not run afoul of this statute (though the operator had best check the liquor licensing requirements in the particular county he's in).
    Otherwise, just because you hired a driver doesn't get you out of the open container laws.
