    Unhappy Sale of Former Marital Home After Divorce

    My question involves personal property located in the State of:



    Here is the situation, My mother recently divorced my step dad. When they initially separated, he stayed in the home and remained there until the divorce was final. Then out of the blue he decided that he did not wish to live there anymore and my mother moved back in the home. She tried her best at first but he soon became a struggle to make the payments, and was trying to get a loan modification. In order to do that she had to miss three payments and was trying to do so. But my ex dad interceded and made payments to stop her from being able to get the loan modification. My mom eventually had no choice and had to sell the home. She made a small profit and now he is suing her for the payments he made and his lawyers fees. Is it smart for her to decide to settle or should she try her hand in court?

    We are not privy to the divorce decree or anything else, such as the state. Have mom sign up if she wishes answers.

    what does the divorce decree state in regards to the debts and assets of the parties?

    when was the divorce finalized in relation to the step father making the payments.??

    did your mother request he make those payments? If so, was there any discussion as to repayment?

    and you were already asked once but what state is this in?


    was the home in only your mother's name?

    did she own it prior to the marriage?

    Would it be correct to infer that his name was still on the mortgage, she was supposed to make the payments pursuant to the divorce judgment and the provision allowing her to stay in the house, she didn't get his permission to skip mortgage payments, and he covered the missed payments in order to protect his credit?
