My question involves a condominium located in the State of: Florida
Regarding the closed thread of 03-13-2010 "Who's Responsible for a Water Leak into a Lower Unit", which is closed, I notice similarities of what is said there an my condo, except that the water seems to be coming form the lower faucet of the tub when I open it for the water to run very fast. The shower use (i.e., the use of the high shower head on the wall) does not cause any leak at all, it seems to be the lower faucet, and according to what I was told by a plumber who looked at it (whom I was supposed to hire), it might be the drain, which is away from the common wall separating my unit from the unit besides me. There is a big hole in the ceiling below now with a lot of debris on the tub (the unit below has been abandoned for quite a while now, and I was told be person B below that it belonged to the bank).
2nd related question to the issue: The HO Assoc. Manager and Maintenance Company Owner (Person A) told me about three weeks ago when I first saw it and entered the unit with Him, which is empty and owned by the bank, that it was caused by an overflowed tub or leaking water from the old cracked caulks of my tub. I never have filled the tub since I do not sit in the tub, I only shower standing. He also then another day said it might be the cap under the lower faucet, which has a hole in the bottom and water might have slipped by.
Then when the plumber came, this past Saturday,, the resident manager (Person B) and maintenance person, who works for person A and is the Maintenance person of the condos, also was asked in soon afterwards and he was informed there by the plumber of the plumber's findings. The resident manager (Person B) told me that the pipe has leaked a long time way back and that it was repaired then with tape, something that contradicted what Person A, the HO Association and Condo Manager, originally told me about two weeks or so before.
We decided not to continue, since the plumber said that had to open a larger hole to investigate further and to do the work, and we all agreed to call Person A to inform Him and to ask for His imput and permission, since the hole had to be enlarged. Person B, the resident maintenance and manager called Person A by phone, could not reach Him at the moment, but then that afternoon He told me that Person A said it will be OK for the plumber (which I brought in to look at the issue, and see the cause and cost of repair) to do the repair, and that I should do it. The Plumber was gone already after I agreed with Him that He will return when I get permission for the repair from Person A. Person B told me then, after He talked to His boss, that it would be OK to make the hole bigger and that I should hire the plumber and then He (Person B, the manger) would repair and close the hole with drywall.
What do you think about all this?
Who is responsible for the leak from the tub, if this is what it is?
