    Default Child Care During Summer Visitation Schedule

    My question involves a child custody case from the State of: florida

    wife and I have split....in process of divorce....first court hearing end of june

    this is my question

    during the summer she has always swithched her work schedule to work 2nd shift while I worked day shift
    so one of us will be with the now 12 year old....

    most of the time I work til 5....she goes in around 2

    so the child is alone for 3-4 hours....
    which is not a problem...he is very capablle of taking care of himself for a few hours

    thing is she would rather our child stay at her home with her "roommate"
    then be left alone....

    the roommate has certain mental issues..but nothing that can be proven he is incapable of watching the child
    I just think he is a bad role model and I would rather my son not be left alone with him.....

    If I leave the child alone rather then leaving him with this man

    will it look bad in court when the time comes ?

    Request first right of refusal be included in the custody order. Remember, that wind blows both ways.

    Personal opinion, not legal opinion.

    I had a similar situation with my kids when they were young and started leaving them home alone for several hours after school when my son was 10 and my daughter was 8.

    A 12 year old who is home by himself for a few hours isn't likely to raise any eyebrows.

    I suggest, however, that you try to negotiate an agreement with your wife before you get to court. Otherwise things are likely to get real hostile, if they aren't hostile already.

    This may just be her first salvo to test the strength and resolve of the enemy. Yes, divorce is war, and your wife is your enemy.

    I infer from that, that you're separated. Is the mother's home the child's primary residence? Is "roommate" a euphemism for "new boyfriend"?

    I'm not seeing how your proposal would work from your end. You work until five, she starts working at 2 PM. So the child would be with the roommate from the end of mom's parenting time (when she leaves for work) to when you go over to her place to pick him up several hours later. How would you arrange for the child to be alone at a different location while you're still at work?

    Did you discuss your concerns with your wife? If so, what was her response?

    You mean, assuming nothing bad happens while the child is alone?

    In a custody situation, absent a court order to the contrary, each parent is normally responsible for his or her own child care arrangements during their time with the child. You and your ex- should try to reach an agreement as to the age at which your son is old enough to spend a few hours at home, alone and unsupervised, between your respective work shifts. If your wife has valid reasons for concerns (and 12-year-olds do get into mischief) you can also consider proposing using a different caregiver.

    neither home is "primary residence..we are doing 50/50 time sharing..but I have the home that he has lived in since he was 5...she moved out on her own accord...she canvery easily drop him
    off here on her way to work and let him stay here with the 2 dogs until I get home"
    and as far as roommate or boyfriend....I don't know nor really care...she keeps saying that he is just "renting the other bedroom" from her...but this person left his life in another state and moved
    across country to be here...so in my opinion if they are not involved...she is letting someone that has let her and the world know that he has been in love with her for 30 years...and she is just letting him share the house ?....does that sound normal or healthy on anyone's part ?....just my opinion..

    it is and always has been hard to discuss things with her....she has to be in charge....one main reason the marriage did not work....

    If you're asking if you can compel your wife to drop your son off at your empty house, when she prefers to have him watched by her roommate while you finish your shift, not without a court order. And it's unlikely that a court will issue such an order if your concerns about the roommate aren't more substantial than what you've shared here.

    can't really prove anything about the roomate,,,,did an online background check
    and all that came up was a "state warrant that has something to with non-payment of business taxes"

    I just feel my child is better off to be alone than with this person....based on just some of the stupid comments he has made
    to my other children...whom are adults and won't go spent time at there mothers if they can help it at all....

    bringing up another question....stepson..18 is liveing with me in the family home rather then live with his mother....
    my attorney asked if he could supoena him to testify to that fact....I told him I would rather not
    get the other children involved....any opinion on that matter ?
