    Default Changing My Child's Last Name From Mine to My Fiancé's.

    My question involves name change laws in the State of: Pennsylvania
    Hi I have a daughter by another man and she has my last name now and I was wondering when I marry my fiancé (who I have another child by) will my daughter's last name need to be changed since I'm hyphenating my last name? Also will my daughter from my fiancé have to change her name as well since she has my name now.

    You have to apply to the court, informing the biological parent in the process. The best interests of the child (NOT YOU OR YOUR NEW LOVE INTEREST) will be the determining factor. There's a strong preference in Pennsylvania to the natural bonds of the child. Name change isn't some casual thing on children. If you want to enforce some alternative paternal relationship, you're going to need to do that with something more involved than a name change order.

    Ordinarily I'd agree, Ron. But the child doesn't actually have Dad's last name at the moment - that might make it a bit more difficult for Dad to object.

    So what do u think I should do because I want both of my kids to have the same last name as me or same last name in general.

    Why not have your soon to be husband change his name to yours?

    He doesn't want to, that's why I wanted to hyphenate my name and see if I can change my kids last name which one of them is his.

    Eh? All dad has to say is he objects. It's not hard. He certainly can make a good argument that the mother's name alone is preferable to adding some stranger's name.

    He can object all he likes, but (perhaps unfortunately) given that that the child has never borne his name to begin with...

    so since my child has my last name the father can still object even thou she doesn't have his last name
