    Default Pregnant with Boyfriend's Child While Still Married

    My question involves paternity law for the State of: Illinois

    I've been married to someone I've grown to quite despise since December of 2010 and currently pregnant with someone else's child. I was told my husband would have to be on the birth certificate since he is the "legal father." Is this true or is there a way the guy whom I'm pregnant by can be on the birth certificate instead? My husband doesn't have a clue the child's not his yet, and I have yet to file for a divorce (long story involving finances on both topics).

    Not without your husband's consent.

    You won't be divorced before the birth, either.

    If your husband won't consent, your boyfriend will have to file a paternity action.

    There is actually another option, and that is to have no father listed on the birth certificate. Then address the issue of the child's paternity in the divorce, and then afterwards add the actual father's name to the birth certificate.

    Can you do that in Illinois even if you're married and not legally separated?

    Yes, you can...but it takes some putting your foot down with the people at the hospital...and certainly your husband would have to know what's going on rather than springing it to him in the hospital while you are giving birth.
