    Unhappy Can I Get Unemployment Benefits if I Was Forced to Resign

    My question involves unemployment benefits for the state of: Alabama
    I was offered to resign or be terminated in my job of 8 years for stealing. Of course I resigned because it was better for me for future employment. No legal action has been taken as of yet and I dont know if it will or not. I was allowed to just admit what I had done and go home after I resigned. Please know I am terribly sorry for what I have done and it has changed my life yet changed me for the better. I only did it to feed my family in a terrible time and it has plagued me so much I will NEVER take anything thats not mine again. My question is....do I still qualify in the state of Alabama for unemployment benefits even though I resigned? And does my reason for resigning (stealing) make a difference in my qualification for benefits? Thanks for your time.

    I don't think you're going to qualify, but you won't know until you apply.

    Even if you didn't resign, theft would generally preclude you from qualifying.

    Concur with Doggie.

    As a general rule, if you resign, unless you do so for a VERY good reason (like your health and safety was in immediate jeopardy), you don't qualify for UI.

    If you are terminate for cause, you typically don't qualify, either. That said, stranger things have happened. I once worked for a company where a fella stole a company car, was terminated, and still somehow won his UI appeal.

    I assume you are asking if this incident will preclude your filing in the future against another employer.

    Surely, you aren't planning to file against the employer from whom you stole, are you? If you do, unless they are REALLY GENTLEMEN, they will contest your benefits. Your filing could possibly serve as a catalyst for them to pursue legal action against you, as well. If the theft can be proven, it is very unlikely you will be granted benefits.

    However, this termination should not affect future claims with a different employer - if that was your question.
