My question involves criminal law for the state of: OHIO
In 2008 my ex husband verbally agreed to cosign my student loans for 37000. He gave me his drivers license photocopied picture to send in and went to work that day forgetting to sign. I called him and he said go ahead and sign it your my wife I cosigned the other one before. I signed it. I just divorced him in nov 2012 and one month later he went to the bank and claimed fraud because he wants off the loans after they told him because I went back to school the whole paying for two years to release your cosigner started over when I returned to school. He didn't want the divorce, found out I have a boyfriend, and I am moving after he moved 6 houses down from me. I have been paying on these loans on time for 3 years. I talk to the bank and I told them I did sign the loan with his consent but I cant prove he verbally consented. They said they are going to accelerate the loan and make it due in full even though I have been paying the loans on time and because he claimed fraud. Will the bank look to prosecute me for fraud or just put this loan in collections even though I have been paying them? I am really scared because he is a father that is not involed in my childs life, I am a nurse, and I only signed because he agreed. He is on another loan with me with the same bank but is ok with that one because he signed it and its only 5000? What should I do.
