    Default In Laws Put Us in a Home and Now Are Trying to Take It Away What Should We Do

    My question involves real estate located in the State of: New Jersey



    *Sighs* Now what? We had a fight with our in laws while they were moving us into our new place. Our in laws say because the home isn't closed yet they're backing out of the deal, but we've already moved in. We have all of this written correspondence between them & the owner of the property which I will post below... We have the keys, we do not have access to hot water because the owners need to unlock the propane tank & we have an infant child here. We waited 6 months for this deal, gave notice to our old landlord. We have some signed contracts as well saying that we can move in on May 15th & it is a 2 year contract. I haven't disclosed any names because I want to protect everyone's privacy. If we had known all of this we would have rented our OWN place.



    Owner: This is to serve as notice that we intend to vacate the above premises on Sunday, May 19th by 2 pm

    The purchasers may move in after that time and will pay rent in the amount of $ 23.38 per day until we close.
    It is our understanding from DMV that they will provide some documentation that title is "fine" and will be mailed once file is completed.
    We do not anticipate this going longer than May 24th and expect it earlier.

    Realtor: Hi, "In Laws" ..Below is what Sellers have provided.

    I recommend that you write back to me stating that the statement below is acceptable to you with the added comment: Should closing not take place prior to June 1, Sellers agree that you will pay the $725 monthly fee to Finns and deduct it from the $26,500 (which I had written but was omitted). And then use your full name as Buyer.

    The terms are acceptable. The Owner will vacate the premises on May 19, 2013 by 2pm. I "In Laws" will pay the daily amount of $23.38 to Finns Mobile home park, for May 2013. If I do not receive the title by June 1st 2013, I will pay the maintenance fee to Finns in the amount of $725.00 for June. If that is the case the maintenance fee will be pro-rated accordingly at the time the title is received and we close.

    I suggest you move, unless you have a lease with the trailer park. Otherwise it appears they will be evicting you.

    You should start by following the forum rule against double-posting questions.

    I have no access to your "signed contracts" so I have no way of interpreting them, or what the two year reference is about. Tell us the relevant details.

    If you're asking whether somebody can offer to make a gift to you, then change their mind before the gift is completed, yes, they can.

    Beyond that, clarify what you're trying to ask.

    I showed a few of the agreements my in laws made with the owner. The owner has vacated the premises & has given us the keys. We had a fight with my in laws who are buying the home. We moved in two days ago. We waited 6 months for this deal to happen & if we had known they were going to take it away from us 2 days after our move in we would have found a different place to live. Our in laws now have decided to back out of the deal. They made agreements with the owner to pay her maintenance fees until they can get the title for the home. All of which I copied & pasted above (Without names to protect their privacy.) My in laws are telling we must move on June 1st but in the agreement above it is stated that my in laws are going to pay the maintenance fee regardless of getting the title or not. I had a verbal agreement with my in laws to pay the maintenance ourselves. We are prepared to pay. Do we have any rights in this situation at all? How do I get a copy of a 10 page lease on this forum? I signed a lease with my in laws to protect our move. I just don't know what to do or what kind of topic this is that is why I posted in a few different places.

    The rule against double-posting isn't just for other people.

    You can have your documents reviewed by a lawyer in your state.

    I'm not sure why people believe that they should get into bitter arguments with people who are doing them enormous favors. Did you try apologizing?

    If you want us to try to help you, you need to post a clear, coherent narrative and then ask a clear, coherent question.

    You are not party to their contract. You have no apparent standing in it. You have been advised when you need to move by. It appears you do not have lease with the trailer park.

    This is my situation. We did not have a "bitter argument." We had a disagreement about painting the whole entire home & moving everything in all in one day. It was too overwhelming & since they did not get their way they lost it & took away the home. Do I have any rights at all? I was given keys & my in laws put me in the home with a 2 year lease before being able to purchase it since the seller lost the title. The lady let us move in since the money was deposited in escrow. My in laws made an agreement with the owner of the home to pay her rent for both May & June to allow us to move in early. The in laws made a written agreement with the woman who is selling the home. She is all moved out at this point & we were unpacking & moving in. If anything are we at least owed damages for having us move in & then pulling out of the deal?

    And is the woman who moved out of her house also owed damages if they do not go threw with this deal?

    did YOU sign a 2 year lease? if so when does it begin and what does it say about unilateral cancellation prior to the start of the term?

    None of the activities between the buyer and seller relate to you. What relates to you is any leases you signed. Otherwise you are a month to month tenant or an illegal tenant and will be moving soon.
