    Question Does the Custodial Parent Have the Right to Deny or Supervise Visitation

    My question involves a child custody case from the State of: california

    my husband has sole legal and sole physical custody of his son does he have the right to refuse visits from the other parent if he deems it unsafe when it comes to his sons mental and emotional well being and does he have a right to supervise the visits when they do happen

    If the court order gives your husband the right to deny or supervise visitation, then he has those rights. If not, and he wants those rights, he should bring a motion (properly supported by law and fact) asking the court to grant him those rights.

    ok the mother of his son has a husband that had a 6 year sentance that he servered for corporal punishment and torture of a child. last year he hung my husbands son upside down over the balcony at there home and told my son that if he told any one the next time they were alone he would drop him and he would die and wouldnt ever see his mother again also there is past demestic violence in this marriage between the mother and her new husband what should my husband do

    there are no visations set up in his orders all the paper work states is reasonable rights to visitation but nothing is filled out

    Why the heck didn't your husband do something last year when that happened to the child?

    we were going thru a dcfs case at the time the child told a nurse praticner that was conducting an forensic exam and nothing came of it my husband stopped all visitation because the mother new the child was not to be alone with her husband he figured because dcfs didnt do something then there was nothing he could do since then we have been trying to set up supervised visits with the mother but she refuses to do supervised visits and the child has only spent about 12 hours with here in the last year. when my husband went to mediation they told him he had the right to choose when she got visits but nothing says he has that right the mother wants to take us back to court and we just want to make sure we are not in the wrong we want the child to see his mother but we do not trust her alone with the child
