    Default My Sons Father Took Him to Another State, How Do I Get Him Back

    My question involves a child custody case from the State of: Minnesota

    I was granted primary custody of my son 4 years ago. His father was to receive parenting time and ordered to pay child support. 2 years ago I let my son stay with his father because I was doing very badly financially and I needed to work and couldn't afford child care. Since then my sons father took my son to wichita Kansas and has never returned him. I flew down last march and spent 4 days with my son in a hotel. Since that time I have not been allowed to speak to my son or see him at all. My sons father disconnected his phone and so I had no way to contact him. I can't live like this anymore. I need my son in my life.

    What can I do? I live below poverty so I cannot afford an attorney. I have contacted legal advice clinics so hopefully they will call me back. Can I call the police in wichita since I have a court order granting me primary custody from four years ago even though he hasn't been with me for 2 years? Should I fly down to wichita and try to go to the police with my order?

    My sons father recently contacted me asking for his original birth certificate because he wants to take him overseas. I absolutely will not give it to him or sign for a passport. I haven't even been allowed to see him. I am afraid he will try to get my son over seas.

    Please any advice.

    Try contacting Mid-Minnesota Legal Aid http://mylegalaid.org/get-help/ according to their website they can help with child custody issues


    Also contact the police if your court order grants you custody

    Dad has an absolutely excellent chance of retaining custody here - and you may find yourself ordered to sign the passport app.

    You've essentially "okay"-ed the move, and Dad having custody. I doubt heavily that the police will get involved.

    Yes originally i allowed him to go to his dads but i did not agree to never seeing or speaking to my child again. I have not been allowed to speak to him for a whole year. Isnt that parent alienation or something?

    What could i do about it? This is why i am here trying to figure out what i can do about it. He may be able to retain custody but i should have the right to have a relationship with my son.

    In the best interests of your child, it makes no sense to be taken from his current home and school etc.

    So, file to modify custody and obtain an enforceable visitation order, perhaps including Skype/webcam/phone parenting time. Be specific as possible, including who will be responsible for transportation, which parent gets which holidays, that sort of thing.
