My question involves criminal law for the state of: CALIFORNIA

My wife and I were talking to a woman online as friends and this woman became attracted to her and started harassing her and I. We have gotten a restraining order against her. It she violates it. Week not know this woman's real name, have her address or other identifiable information. She follows us, texts from an app-based phone number, makes death threats and has committed battery against my wife. Yeateday she tampered with my truck with the intention of causing my wife and kids to into a fatal accident. I know it was her because it was confirmed that my truck was intentionally tampered with and no one else would do such a thing. We have no proof other then a text she sent asking if I liked her 'surprise' and that I 'killed her love (among me for her actions). Sorry this iong. This woman is dangerous and police said they will not trace the phone number and that they cannot take a report for the amateur to my truck (which resulted in my wife and kids getting stranded on the fwy) becaue we have. I evidence that it was her. This woman is causing my family a great deal of fear and stress and we need this to stop. Any help on the matter would be immensely appreciated. Thank you.

So, your wife managed to get a CHO against a woman harassing her by email or chat? That's ... interesting. Especially since you don't even know her name, address or identifiable information and the court could not possibly issue one. It would be virtually unenforceable under those circumstances.

What court issued this "order" and who is it issued against?

You know her on line, yet she physically attacked your wife? Did she report the battery? Was she able to identify the woman to the police?

So far, all the things you have mentioned (aside from the vehicle tampering - which can't be tied to her) are low level misdemeanor criminal offenses in CA and the police can NOT obtain a search warrant for the information they might need to try and identify the suspect. If they had the time, they could pursue the matter by subpoena, however. But, given the nature of the offenses (online harassment) and the likely lack of resources, I doubt they will follow-up on it.

Legally, there is no proof WHO did it, then. If your mechanic is willing to testify in court that it was physically tampered with, that's great. But, he can't say WHO did it and unless you have any witnesses that put the mystery woman in the area, she'll never be charged.

To begin with, I would suggest no communication with the woman. Do not reply to calls, texts or emails. Save them if they come.

Second, purchase a home surveillance system with motion activated lights and cameras so that you can record anyone who comes onto the property.

And if you really want to find out who she is so you can get a real order against her, hire a private investigator who specializes in electronic harassment or computer issues.

So you have a Jane Doe restraining order? She keeps stalking you, yet you keep responding to her? You know she beat your wife and tampered with your truck? Honestly, it sounds more like you tampered with the truck and are terrorizing your wife.
