    Default Negligent Assisted Living Facility

    My question involves medical malpractice in the state of: Florida

    My sister who is Mentally Ill, was living in an Assisted Living Facility, somehow got a hold of her room mates medication, and took two bottles of pills. She was rushed to the hospital, and was in the ICU on a breathing machine in danger of losing her life. Do we have a case for negligence against the Assisted Living Facility?

    They were in a drawer on top her roommates dresser, according to her.

    Correction, either in a drawer or on top of the dresser. She's still a bit fuzzy after waking up.

    Do you expect the Assisted Living Facility to be able to monitor your sister 24/7? Keep her restrained at all times? (note; that would be illegal).

    There are different levels of care. It apparently is your fault for keeping her in a lower level of care than she needed.

    Was this a suicide attempt? If so, did the facility have any reason to believe that your sister was suicidal?

    Does your sister have a history of taking other people's medication?

    Does the facility ordinary store medication, or is this a facility in which the clients keep their own medication and manage their own dosing? (Adding nursing staff to store and distribute medications around the clock, after all, is very expensive.)

    Its possible that the OP is using the term "assisted living facility" incorrectly. A roommate situation would be a bit unusual for an assisted living facility...or at least the assisted living portion of the facility.

    The term could also be used to describe a residential care home or a personal care facility. These types of living arrangements are set up to provide the residents more focus on a home-type environment than, say, a nursing home situation.

    I agree, but both of those situations would require a greater degree of supervision than a traditional assisted living facility. Traditional assisted living gives private living quarters to seniors or others who can basically take care of themselves for the most part, but require someone checking on them periodically. That is far different than a roommate situation.
