    Question How to calculate demand for missed work

    I have a question about what "missed work" I can include in my demand related to injuries sustained in an auto accident. The state is New Hampshire.

    I have calculated my medical special damages and have doc notes as well as a letter from my employer that lists the actual number of days I was out of work due to the injury. However I also had to go to doc appts, physical therapy and a chiropractor many, many times. The actual amount of time (and mileage) to attend these appointments is more than double the actual number of days I missed.

    My question: in my demand can I include the hours and mileage spent going to appointments as missed time from work (and expense, re: mileage)? My argument is that all of the appointments were during daytime hours (workdays, and I work full time) and I was expected by my employer to "make up" that time either by going to work early, staying late or working from home. I'm salaried, but my work had to get done. I would further argue that it was a major source of frustration and embarrasment for me to leave for 1-1.5 hour appts 2-3 days a week for a few months.

    Any thoughts?

    You're trying to negotiate directly with the insurance company? Ask for the most you can reasonably justify, as they will ordinarily take the position of seeking to reduce or deny any claim you make.
