    Wink Car Dealer Won't Sell Vehicle for Adverised Price

    My question involves a consumer law issue in the State of: California

    We saw a price on a 2006 chrysler 300 touring for $4,991 internet price, we went directly do dealership. When we arrived the car was there but marked $13,995 . We looked at it and a couple others and left. We told the Sales Guy about the price on internet and he said "it was wrong" and the site we found it on it was removed when we looked today. However, then we checked several other sites which included 7 of them where the price was $4,995 on one in particular it said orig. price is $13,995 and dropped today to $4,995. Does the dealer have to honor?? I believe that found in that many locations It is beyond the Bait and Switch and is now deceptive advertising? Please advise, and Thank You.

    You should refer to the terms of the site you obtained the price from. Your issue is that the "internet" price usually involves buying it through the internet method prescribed. Even if there was no disclaimer, which I find unlikely, you did not attempt to buy via the internet method, you appeared in person. The ad will likely be removed and thus no longer valid.

    make a complaint to your attorney general's office would be my advice .. check first and find out if he has a history with the AG ... note it to the AG if so in your complaint

    you are talking internet price postings I assume?

    Mistakes happen, This sounds like an error in the price. The price that you found in the ad is so far from the expected sale value that you shouldn't be surprised that it was wrong. The dealer does not have to honor the price and it's not deceptive advertising, it's a mistake.

    You can complaint about the dealership to the Attorney General's Office. The DMV also takes complaints, but I don't think they have jurisdiction over this type of issue.

    Mistakes happen, and given the difference between the advertised price and the market value of the vehicle it would be pretty obvious that the price was probably a mistake. If the dealership has a history of "bait and switch", it's more likely that this was misconduct, but if this is a one-time event, sometimes clerical errors find their way into ads - and the mere fact that an ad includes an incorrect price does not, of itself, mean that the company has to offer the item at that price.
